An exploratory study of the applications of Wilayat Nikah in Sharia

Abstract

Islam defines marriage as an intrinsic relationship between a male (husband) and a female (wife) legally tied nuptial Knott for the whole of their life . In Islam marriage is the very fundamental unit of the structure and functioning of a society and is acting as a vital pillar for strengthening the basis of a society. Therefore, every man and woman chooses a spouse to live their married social life with modesty and chastity. In the happiness of marriage life , prosperity and happiness increase, and to achieve this goal, the guardian of marriage. Whether or not, begins his new life by exercising his or her guardian’s powers. Then the family and the society are on the verge of destruction due to not exercising these powers and the province of marriage properly, violating the rules of  Nikah or not enforcing it through oppression. Now days some writing scripts on the subject of Nikah have become an adornment of the market, but this subject has been sabotaged by entangling it in the mire of chaos. That when a man and a woman like each other and want to live together, why does religion or Sharia deprive them of their rights and give them to their saints who live apart from them? Therefore, in order to present the subject of province of marriage properly in a well-defined and researched manner Therefore, to present the subject of Wilayat Nikah in a well-defined and researched manner, the applications of Wilayat Nikah will be presented in a clear manner.
